1. Acceptance of Terms

By downloading, installing, or using the Vokabelly mobile application ("App") or visiting our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use Vokabelly.

2. Description of Service

Vokabelly is a German vocabulary learning application that helps you build and review vocabulary through:

• Text translation with interactive word tapping
• Flashcard creation and personal deck management
• Spaced repetition review using the SM-2 algorithm
• Camera OCR (text recognition from photos)
• Voice input (speech-to-text)

The service is available in both free and premium tiers.

3. User Accounts

• You may use Vokabelly anonymously or create an account using your email address.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when registering.
• You may not create multiple accounts for the purpose of abusing the service.

4. Free and Premium Services

• Free tier: Core translation, flashcard, and review features, including camera and voice input, A1 and Top 500 word decks.
• Premium tier: Additional features including unlimited decks, curated CEFR decks (A2-C1), themed vocabulary packs, advanced review settings, and an ad-free experience.
• Subscription pricing is displayed in the App and on our website. Actual charges are processed by the Apple App Store or Google Play Store.
• Subscription management, including cancellation and renewal, is handled through your App Store or Google Play account.

5. Acceptable Use

When using Vokabelly, you agree to:

• Use the app only for personal, non-commercial vocabulary learning purposes.
• Not attempt to reverse engineer, decompile, disassemble, or hack the application.
• Not use automated systems, bots, or scrapers to access the service.
• Not submit spam, offensive, or illegal content through the contact form or any input feature.
• Not interfere with or disrupt the service or servers connected to the service.

6. Intellectual Property

• The Vokabelly application, including its design, source code, graphics, and content, is owned by us and protected by intellectual property laws.
• Word definitions, example sentences, and curated deck content are our intellectual property.
• Your personal flashcard decks and learning data remain yours.
• You may not copy, modify, distribute, or create derivative works based on Vokabelly without our written permission.

7. Content and Translations

• Translations are provided for educational purposes and may not be perfectly accurate.
• We do not guarantee the completeness or accuracy of any translation, word definition, or example sentence.
• Do not rely on Vokabelly translations for professional, legal, medical, or official purposes.

8. Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising from the use of the service shall not exceed the amount you have paid for the service in the 12 months preceding the claim.

9. Termination

• You may stop using the app and delete your account at any time.
• We may suspend or terminate your access if you violate these Terms of Service.
• Upon termination, your right to use the app ceases immediately.
• Sections regarding intellectual property, limitation of liability, and governing law survive termination.

10. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of Vokabelly after changes constitutes acceptance of the revised terms.

11. Governing Law

These Terms of Service are governed by and construed in accordance with applicable law. Any disputes arising from or related to these terms shall be resolved through appropriate legal channels.
